Do Not Sell or Share My Personal Information
We don’t. We never have. Here is what that means, what the words actually cover, and how to hold us to it anyway.
Not to lead buyers. Not to lead aggregators. Not to affiliate networks. Not to data brokers. Not for money, and not for anything else of value.
In the twelve months before the effective date of this notice, Genesis Home Loans sold no personal information and shared no personal information for cross-context behavioural advertising — including none belonging to consumers under 16 years of age.
This page exists anyway, because California law requires a clear and conspicuous “Do Not Sell or Share My Personal Information” link (Cal. Civ. Code §1798.135), and because a business telling you it does not sell your data should give you a way to hold it to that.
1. The short answer
You landed here from the footer link, and you probably expected a form, a cookie banner, and a fight. There is no fight. We have nothing to switch off, because we never switched it on.
Mortgage lead data is one of the most heavily traded data sets in America. A single “ready-to-buy” mortgage lead sells for real money, and plenty of brokerages fund themselves that way — quietly, in the fine print, while telling you they are on your side. We do not. Your file is a mortgage file. It is not inventory.
2. What “sell” and “share” actually mean under the CPRA
- “Sell”
- Disclosing personal information to a third party for monetary or other valuable consideration. “Other valuable consideration” is broad on purpose — a barter, a discount, or a reciprocal data swap all count. We do none of it.
- “Share”
- Disclosing personal information to a third party for cross-context behavioural advertising — that is, so somebody can follow you around the internet with ads based on your activity somewhere else. We do not do this either.
- What is not a sale or a share
- Giving your application to a lender because you told us to submit it. Sending a document to escrow so your loan can close. Using a service provider, under a written contract, to store a file or deliver a text message. These are disclosures for a business purpose, and the CCPA treats them differently for good reason — without them, you do not get a mortgage.
3. What we do instead
Everything we disclose, we disclose to get your loan closed, and only to people contractually barred from using it for anything else. The complete list of who and why is in §6 of our Privacy Policy and §6 of our California Privacy Rights notice. Nothing on either list is a buyer.
4. Your mobile number, specifically
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from every category of sharing we describe anywhere, and will not be shared with any third party — for value or for free.
The only parties that ever touch your mobile number are (a) the messaging platform that physically delivers the text you asked for, under a contract that forbids any other use, and (b) your own carrier. That is the entire list.
If you would rather we did not have the number at all, reply STOP to any message, or call us and say so. We will delete it from our messaging system and call you instead. It will not affect your loan, your rate, or how fast we work.
5. Global Privacy Control — read live, on this page
We honour the Global Privacy Control. If your browser or a privacy extension sends the GPC signal, we treat it as a valid, legally binding opt-out under Cal. Civ. Code §1798.135(b) and 11 CCR §7025 — automatically, with no account, no form, and no email address.
Whatever it says above, the outcome is the same: we are not selling or sharing your information. GPC just means you did not have to ask.
If it says we are not seeing a signal and you would like one sent, GPC is supported by Firefox, Brave, DuckDuckGo, and by extensions such as Privacy Badger. Turning it on protects you across every site that honours it — not just ours.
6. Opt out anyway
You may submit an opt-out request without verifying your identity — the law does not require verification for this one, and we will not invent a hurdle. Any of these works and all of them are free:
- Use the form on our California Privacy Rights page and choose “Opt me out of sale / sharing.”
- Email deanda.adriana@gmail.com with “Do Not Sell or Share” in the subject.
- Call (408) 569-9288 and say so. Adriana answers her own phone.
- Write to 1313 N Milpitas Blvd, Suite 235, Milpitas, CA 95035.
- Turn on GPC and do nothing else.
We action opt-outs within 15 business days, as 11 CCR §7026(f) requires. In practice, since there is nothing to stop, it is instant — and we will write back and tell you so.
7. Sensitive personal information
We collect your Social Security number or ITIN, your government ID, and your financial account numbers — because no lender will underwrite a mortgage without them. We use them for that and nothing else. We do not use sensitive personal information to infer characteristics about you, and we never sell or share it.
Because we use it solely for the purposes permitted by Cal. Civ. Code §1798.121(a), we are not required to post a “Limit the Use of My Sensitive Personal Information” link, and we do not — a link that leads to a page saying “we already do this” is theatre. If you want written confirmation for your records, ask us and it will be in your inbox the same day.
8. Authorised agents
An authorised agent may submit an opt-out on your behalf. We may ask the agent for proof that you gave them permission, as 11 CCR §7026(c) allows — but we will not require you to verify your own identity for an opt-out, because the law does not permit us to.
9. What happens after you opt out
- We record the date, the method, and the scope, and we keep that record.
- We confirm to you in writing.
- Nothing about your loan changes. Not the rate, not the programme, not the speed, not the level of service. Retaliating against you for exercising a privacy right is illegal under §1798.125, and it is also just a rotten way to run a brokerage.
- We will not ask you to opt back in for at least 12 months, as 11 CCR §7026(g) requires.
- Your opt-out does not delete anything. If you also want deletion, ask for that separately on the rights request form — though note that a funded loan file is one we are legally required to retain for years.
